Lease Assignment at a Health Care Facility

Occasionally our clients request that we represent them either as a landlord or tenant concerning lease assignments. Such lease assignments can be very complicated and the lease terms should be closely followed in any such assignment. One of our clients owns a nursing home that was leased to a well-known nursing home operator. The operator wanted to cease its operations at the facility, but Mr. Michelsen objected to the first proposed assignee of the lease based on a review of their background, and the client followed his advice. Thereafter, a second proposed operator was interviewed and was acceptable to the client. The client was advised by our firm in the negotiation of the various lease assignment documents, which included the resolution of a long-standing legal issue between the original lease parties. In addition, the repair of the HVAC system was completed as a condition of the lease assignment.
